Consent and Agreement to Receive Account Statements Electronically
Read this document carefully and keep a copy for your records. If you are unable
to print this document, the Credit Union will provide a copy to you upon request.
This agreement specifically governs the receipt of your account statement electronically
and informs you of your rights and responsibilities and the terms and conditions
associated with the service you have requested. In this Agreement, the words “you”,
“your, and “yours” mean each and everyone who utilizes eStatement services. The
words “we”, “us”, “our” and “Credit Union” mean the Credit Union. The words “the
service” refer to the eStatement services. Accessing your eStatement confirms your
agreement to be bound by all disclosures and agreements and acknowledges your receipt
and understanding of this agreement.
You agree to be bound by all terms and conditions contained herein which are in
addition to the terms and conditions of the Online Banking Agreement and Disclosure
as well as any Membership and Account Agreement in use. By agreeing to the terms
and conditions of this consent, you represent that you are authorized to enter into
this consent for all persons who own or are authorized to access any of your accounts,
and that such persons will be bound by the terms of this consent and agreement.
You further agree to follow all instructions provided by the service and as may
be reflected on your computer screen. You further agree to abide by any terms and
conditions which may be added due to future enhancements to the eStatement services.
Once you enroll in this voluntary program, your paper statement will no longer be
mailed to you. Although you have elected electronic delivery, you do have a right
to receive a paper copy of your periodic statement. To request a copy of your periodic
statement, telephone us at 1-800-897-6991, or write us at the Credit Union at P.
O. Box 1358, Bartlesville, OK 74005-1358. The list of fees applicable to your account(s)
provided elsewhere may specify additional fees that we may charge for requests to
receive an account statement in paper form.
You may withdraw your consent and revoke your agreement to receive your account
statement using eStatement services at any time. You may do so by calling the Credit
Union at 1-800-897-6991, by writing the Credit Union at P. O. Box 1358, Bartlesville,
OK 74005-1358, or by notifying a member services representative at any one of our
Credit Union locations. The Credit Union may terminate the eStatement service at
any time.
You agree to provide the Credit Union a valid, working email address so that you
may be notified when your eStatement is ready for viewing. You understand that you
have no expectation of privacy if electronic records are transmitted to an email
address owned by your employer or any other persons that are not owners, borrowers,
authorized users, etc. on your account. You agree that the Credit Union has no liability
to you whatsoever for any loss, claim, or damages arising or in any way related
to our response(s) to any email or other electronic communication that we in good
faith believe you have submitted to us. We have no duty to investigate the validity
or to verify any email or other electronic communication; and may respond to any
email at either the address provided with the communication, the email address in
your membership account, or any other application or written communication actually
received by us. Although we have no obligation to do so, we reserve the right to
require authentication of emails or electronic communications. The decision to require
authentication is at the sole discretion of the Credit Union. We will have no obligation,
liability or responsibility to you or any other person or company if we do not act
upon or follow any instructions to us if a communication cannot be authenticated
to our satisfaction. You further agree to release the Credit Union from any liability
if information is intercepted or viewed by an unauthorized party at the email address
selected by you or any email address updates that are provided to the Credit Union.
You may change your email address by calling the Credit Union at 1-800-897-6991,
by writing the Credit Union at P. O. Box 1358, Bartlesville, OK 74005-1358, or by
notifying a member services representative at any one of our Credit Union locations.
To access the eStatement services, you will need to be enrolled in the Credit Union’s
Online Banking service and meet the requirements outlined in the Online Banking
Agreement and Disclosure which you agree to upon registration in your Online Banking
account. Specifically, the system requirements (Hardware/Software) are: a) a personal
computer (PC) or other device that is capable of accessing the internet, and b)
an internet browser that supports 128-bit encryption – for PC users, Microsoft Internet
Explorer 7.0 or higher or Firefox 3.0 or higher; for Mac users, Safari version 4.0
or higher. These are the current minimum requirements that are required to access
and use the system, which may change without notice as technology, software, and
other matters continue to evolve. (As of April, 2010, Internet Explorer version
older than 6.0 are not valid access for Online Banking. Users attempting to access
Internet Banking with a version older than 6.0 will be denied access. If one of
the supported browsers is not used, you may experience functionality issues or be
denied access to Online Banking. Using a Beta version of any browser is not recommended.)
If there is a change in the hardware/software requirements associated with this
service, we will notify you and provide an explanation of the updated hardware/software
requirements. The Credit Union makes no warranty or representation regarding the
access to eStatement services now or in the future which are out of the control
of the Credit Union depending upon your computer system and method of access, e.g.
dial up connection vs. DSL or other connection. In addition to the system requirements
outlined in the Online Banking Agreement and Disclosure, you will need Adobe®Acrobat®Reader®.

It is your sole responsibility to ensure your personal computer and related equipment
are compatible with and capable of operating in a manner that allows you to utilize
the eStatement services. If you cannot meet the requirements for any reason, you
have the right to withdraw your consent at that time at no cost to you. Withdrawing
your consent will terminate your eStatement service.
You agree that your use of a key pad, mouse, or other device to select an item,
button, icon or similar action, or to otherwise provide the Credit Union instructions
while participating in our eStatement service; or in accessing or making any transaction
regarding any agreement, acknowledgement, consent terms, disclosures or conditions,
constitutes your signature, acceptance and agreement as if actually signed by you
in writing. Further, you agree that no certification authority or other third party
verification is necessary to validate your electronic signature; and that the lack
of such certification or third party verification will not in any way affect the
enforceability of your signature or any resulting contract between you and the Credit
Union.
You agree and acknowledge that you will keep confidential your personal identification
information and all security codes to access the eStatement service. You further
agree to immediately notify the Credit Union should you believe any of your personal
identification information and/or security codes have been lost, stolen, or that
an unauthorized person has electronically accessed you account.
The eStatement service is generally available 24 hours a day, seven days a week
except as may be unavailable at certain times due to scheduled or unscheduled maintenance,
system outages, interruptions in telephone service, or electrical outages that can
cause system unavailability. The Credit Union will make every reasonable effort
to ensure the availability of the service; however, the Credit Union is in no way
liable for the unavailability of the eStatement service or any consequential damages
that may result.
There is currently no fee for the eStatement service or termination thereof. The
Credit Union reserves the right to impose fees or to subsequently change any fee
structure with or without notice as required by law.
This agreement may be amended by the Credit Union at any time at its discretion.
You will receive notice of amendments as required by law.
IN CASE OF ERRORS OR QUESTIONS ABOUT YOUR ELECTRONIC STATEMENT
Contact us immediately if you think your statement is wrong or if you need more
information. You may notify us at 1-800-897-6991, or write us at: P. O. Box 1358,
Bartlesville, OK 74005-1358.
We must hear from you no later than 60 days after we sent the first statement on
which the problem or error appeared. Tell us your name, account number, the dollar
amount of the suspected error, and the date it occurred. Describe the error or transaction
you are unsure about, and explain as clearly as you can why you believe it is an
error or why you need more information.
If you notify us verbally, we may require you to send us your complaint or questions
in writing within 10 business days. We will tell you in writing the results of our
investigation within 10 business days after we hear from you and will correct any
error promptly. If we need more time, however, we may take up to 45 days to investigate.
We will provisionally credit your account within 10 business days for the amount
you think is in error so that you may have use of the money during the time it takes
us to complete our investigation. If we ask you to put your complaint or questions
in writing and we do not receive it within 10 business days, the Credit Union is
not required to credit your account.
For transactions initiated outside the United States, the time period stated above
increases to 90 calendar days instead of 45 calendar days, unless otherwise required
by law, to investigate your complaint or question. If your claim is made within
30 days of account opening, we will provisionally credit your account within 20
business days and may take up to 90 calendar days to conduct our investigation.
If we determine there was no error, we will send you a written explanation with
3 business days after we complete our investigation. You may ask for copies of the
documents that we used in our investigation and upon which we relied to conclude
that the error did not occur. These will be made available to you to the extent
possible without violating any other member’s right to privacy.
